OKTO Fit costs $29.99 per month, plus taxes. purpose

These terms govern the use of OKTO Fit, software from OKTO Solutions for private trainers in Quebec and the app offered to their clients. By creating an account or using the service, you accept them. The privacy policy is part of them.

your account

You provide accurate information and keep your password confidential. You are responsible for what happens under your account. Write to us right away if you think it was used without your consent.⁠​‌​​‌‌‌‌​‌​​‌​‌‌​‌​‌​‌​​​‌​​‌‌‌‌​​‌​​​​​​‌​‌​​‌‌​‌‌​‌‌‌‌​‌‌​‌‌​​​‌‌‌​‌​‌​‌‌‌​‌​​​‌‌​‌​​‌​‌‌​‌‌‌‌​‌‌​‌‌‌​​‌‌‌​​‌‌​​‌​​​​​​‌‌​​‌​​​​‌‌​‌‌​​‌‌​‌​​‌​‌‌​​‌‌​​‌‌‌​​​‌​‌‌‌​‌‌​⁠

subscription and price

• The subscription is monthly: $29.99 per month, plus taxes (GST and QST), in Canadian dollars.
• There is no per-client tier: the price does not change with the number of clients you coach.
• Payment is charged each month until you cancel.
• If we change the price, we notify you in writing before the new price applies, and you may cancel before then.

cancellation

You can cancel at any time, without penalty, from your account or by writing to info@oktosolutions.ca. Cancellation takes effect at the end of the period already paid. We may suspend or close an account that breaks these terms, and we will explain why.

your data

The data of the trainer and their clients, meaning programs, meals, contracts and photos, belongs to the trainer. We use it only to provide the service. You can ask for a copy, and when the account is closed it is handled as the privacy policy explains.⁠​‌​​‌‌‌‌​‌​​‌​‌‌​‌​‌​‌​​​‌​​‌‌‌‌​​‌​​​​​​‌​‌​​‌‌​‌‌​‌‌‌‌​‌‌​‌‌​​​‌‌‌​‌​‌​‌‌‌​‌​​​‌‌​‌​​‌​‌‌​‌‌‌‌​‌‌​‌‌‌​​‌‌‌​​‌‌​​‌​​​​​​‌‌​​‌​​​​‌‌​‌‌​​‌‌​‌​​‌​‌‌​​‌‌​​‌‌‌​​​‌​‌‌‌​‌‌​⁠

your clients' payments

Your clients' payments go through an online payment provider. OKTO Solutions takes no commission on these payments. The payment provider may have its own fees and terms, which apply between it and you.

your responsibilities as a trainer

• Obtain your clients' consent to collect their health data and photos.
• Follow the laws that apply to your practice, including charging GST and QST where you are required to.
• Do not use the service for content that is illegal, misleading or infringes the rights of others.
• Do not try to get around the service's security or access another account's data.

OKTO Fit is a management tool. It provides no medical or dietary advice. The programs and advice you give your clients are your responsibility.

availability and liability

We do our best to keep the service running without interruption, but we cannot promise it will always be available or error-free. To the extent the law allows, our liability to you is limited to direct damages and does not extend to indirect losses, such as lost revenue.

If you use the service as a consumer, the Consumer Protection Act applies. Nothing in these terms limits the rights it gives you or those the law does not allow you to waive.

intellectual property

The software, the OKTO Fit brand and the site's content belong to OKTO Solutions. You receive the right to use the service during your subscription, without copying it, reselling it or extracting its code.

changes to these terms

We may change these terms. For an important change, we notify you in advance by email or in the app. Continuing to use the service after the effective date means you accept it, and you may cancel before then if you do not.

governing law

These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. Any dispute falls under the courts of Quebec, subject to the rights the law gives consumers.
